Welcome to Whispercode. These Terms of Service ("Terms") govern your use of Whispercode's voice dictation software, website, and related services (collectively, the "Service"). By using Whispercode, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Whispercode, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Whispercode is a voice dictation software designed for developers. The Service includes:

  • Voice-to-text transcription with developer terminology recognition
  • IDE integrations for Cursor, VS Code, and Windsurf
  • Vibe Mode for AI-assisted coding workflows
  • RAG (Retrieval-Augmented Generation) knowledge base features
  • Custom dictionary for project-specific terminology
  • Floating window and global hotkey functionality

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use Whispercode. By using the Service, you represent that you meet these requirements.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

5. Subscription Plans and Payment

5.1 Plans

Whispercode offers multiple subscription tiers:

  • Free: Limited to 2,000 words per week with basic features
  • Pro: Unlimited words, Vibe Mode, custom dictionary, and priority support
  • Team: All Pro features plus team collaboration, shared dictionaries, and admin controls

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method. Prices are subject to change with 30 days' notice.

5.3 Refunds

We offer a 14-day money-back guarantee for new subscribers. After this period, subscription fees are non-refundable. Contact support@whispercode.io for refund requests.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access to paid features until then.

6. Acceptable Use

You agree to use Whispercode only for lawful purposes. You may not:

  • Use the Service to transcribe or distribute illegal, harmful, or offensive content
  • Attempt to reverse engineer, decompile, or extract source code from the software
  • Circumvent usage limits or security measures
  • Share your account credentials or allow unauthorized access
  • Use automated systems to abuse the Service
  • Interfere with or disrupt the Service or servers

7. Intellectual Property

7.1 Our Property

Whispercode, including its software, design, logos, and documentation, is owned by us and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service.

7.2 Your Content

You retain ownership of all content you create using Whispercode, including transcriptions, custom dictionaries, and RAG knowledge base documents. We do not claim any rights to your content.

8. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. Key points:

  • Voice processing happens locally on your device
  • We do not store or access your audio recordings
  • Account data is encrypted and protected

9. Third-Party Integrations

Whispercode integrates with third-party services (IDEs, AI providers). These integrations are subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. We may:

  • Perform scheduled maintenance with advance notice
  • Experience occasional downtime for updates or technical issues
  • Modify or discontinue features with reasonable notice

11. Disclaimer of Warranties

WHISPERCODE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will meet your specific requirements
  • Transcriptions will be 100% accurate
  • The Service will be error-free or uninterrupted

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPERCODE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Whispercode from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

14. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Service or other users. Upon termination:

  • Your right to use the Service ends immediately
  • You may request export of your data within 30 days
  • Provisions that should survive termination will remain in effect

15. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

16. Governing Law and Disputes

These Terms are governed by the laws of Hungary. Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

17. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Whispercode.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver.
  • Assignment: You may not assign your rights under these Terms without our consent.
